A University of Montreal graduate who was admitted to the Quebec bar in 2004, Geneviève Mercier, CRIA, focuses her practice on workplace health and safety issues. Thanks to her vast knowledge of the compensation plan, she is able to offer support and strategic advice to clients as well as represent clients before the Commission des lésions professionnelles. In addition, she also sits on the liaison committee between the Barreau du Québec / Commission des lésions professionnelles, thus contributing to this court’s direction. Mrs. Mercier is particularly well versed in questions of allocation. In fact, she is the co-author of Réduire ses cotisations de la CSST par transferts et partages de coûts : mode d'emploi, which was published in 2008. She also contributes to various works, publications, conferences and training activities of the Le Corre et associés, s.e.n.c.r.l. law firm. | ||

The use and abuse of intoxicants at the time of an accident, the excessive consumption of prescription drugs after an injury as well as addictions of all kind raise many questions when exploring the backdrop of a dispute before the Commission des lésions professionnelles (CLP). This conference will explore, from a practical perspective, the different cases identified at the CLB involving situations of drinking, drug abuse, addiction and drug dependence, including questions stemming from these situations, ranging from eligibility to cost allocations. Learning Objectives At the end of the course, the participant will be able to: • Understand the consequences of drinking and substance abuse and dependencies when analysing a claim with the CSST or when analysing a transfer request or a cost sharing request. • Understand the CLP case law trend involving drinking, substance abuse and dependencies, when addressing the eligibility of a claim and the cost allocation breakdown.
