COVID-19 AND THE WORKPLACE (Live Stream)
Join our expert panel of labour lawyers from Mathews Dinsdale and a QEII medical doctor specializing in infectious diseases on March 27, 2020.
With COVID-19 appearing prominently in news headlines these days, both federal and provincial governments are encouraging preparedness. What is an employer’s responsibility to employees in the event of wide-scale infection? What steps can an employer take in advance to ensure preparedness? While specific guidelines and responsibilities exist for those working in health care, an employer in any industry can benefit from having a workplace pandemic plan in place.
In the event COVID-19 spreads widely within Canada, employers have the same legal duties under occupational health and safety, employment standards and human rights legislation as they would with any other illness impacting employees. One of the primary considerations will be whether employees can reasonably refuse to attend work for safety reasons if and when COVID19 is present in the workplace.
This session will provide an overview of the obligations employers will have in the event there is a widespread outbreak of COVID-19 in Nova Scotia and will address the occupational health and safety; human rights; and employment related responsibilities employers should be aware of in the coming months. Importantly, this session will also feature important information on the medical aspects of COVID-19 from Dr. Brent Culligan. Dr. Culligan is a is a specialist in Internal Medicine at the QEII Health Sciences Centre.
Learning Objectives
In this session, participants will learn:
- The most up-to-date medical perspective on the origins and spread of COVID-19;
- The various ways in which employers can address the spread of COVID-19 in the workplace, including restricting the activities of its employees;
- The circumstances in which an employer may prevent an employee from reporting to work;
- Whether an employer needs to accommodate lengthy absences from the workplace;
- When an employer should permit an employee to work from home;
- The circumstances in which an employee can refuse work under the Occupational Health and Safety Act; and
- What obligations an employer will have in the event it must close its business for a period of time.

Covid19 and Accommodation of Family Status: What Employers Need to Know Now (Live Stream)
DATE: | April 16th 2020 |
9:00 am to 12:00 am |
CHAPTER: | Webinar |
LANGUAGE: | English |
This webinar is put on by CPHR Nova Scotia
Discrimination on the basis of family status is an ever-evolving concept that arises in every workplace. Many employees are dealing with child-care obligations in addition to care of parents, while employers struggle to deal with the absences and special arrangements that such accommodation can involve. The session will review the current state of the law on family status discrimination and provide a practical guide as to how employers can simultaneously meet the demands of the workplace and their legal obligation to accommodate their employees' family status.
The law on accommodation of family status is not consistent across the country, with some important differences in employer obligations depending on whether the employment is federally regulated or provincially regulated. Some provinces, such as British Columbia, have a different test for reasonable accommodation.
This session will be tailored for Nova Scotia employers, with a review of the obligations to accommodate family status and the limits of that accommodation. We will provide a road map of how to handle such requests for accommodation, including what information may be requested of employees, and what sort of “family matters” may have to be accommodated. Does it include time off to attend a child’s hockey game or just medical appointments? Does it matter if the child has special needs? What if the employee need to care for an elderly parent?
We will review decisions interpreting the Nova Scotia Human Rights Act as well as decisions from Nova Scotia labour arbitrators on this important topic.
In this session, participants will learn:
- The various ways in which the issue of discrimination of family status can arise;
- The law that applies to Nova Scotia employers with respect to family status accommodation, whether provincially or federally regulated and the legal tests and how they differ from some other provinces;
- A discussion of family status issues and benefits;
- Addressing issues of anti-nepotism policies and issues that arise when family members work together;'
- The current state of the law and recent decisions on family status discrimination;
- Proactive policies and procedures that employers can take that will assist in addressing family status issues; and
- A step by step approach that employers can take when their employees do request accommodation based on family status.

Workplace Mindfulness Free Summit- COVID-19 mental health crisis impact on the workplace May 4 to 8th
COVID-19 mental health crisis impact on the workplace
Experts have projected a mental health crisis is underway in the wake of the COVID-19 pandemic. Employee well-being and productivity will be severely impacted. It's time to be proactive and respond with an abundance of care. Recently, Qualtrics published The Other COVID-19 Crisis: Mental Health surveying 2,000 employees and found:
- 67% of people report higher levels of stress since the outbreak of COVID-19.
- 42% report their overall mental health has declined.
The top two things respondents reported impacted their mental health decline were more anxiety (24.0%) and more stress (20.1%)
What is Workplace Mindfulness?
The modern workplace is not a physical location, it is the place, whether physical or online, that people come together to work. Mindfulness is a human ability to be present that is developed through various practices, primarily meditation.
Mindfulness is the basic human ability to be fully present, aware of where we are and what we’re doing, and not overly reactive or overwhelmed by what’s going on around us. (from Mindful.org)
Workplace mindfulness programs have proven to be cost effective measures to reduce anxiety & stress while boosting resilience and fostering mental well-being. The Center for Disease Control's Mental Health and Coping During COVID-19 page lists one of the top methods to cope with stress as meditation. The National Institute for Health offers this resource on "What the Science Says About the Effectiveness of Meditation". And the Society for Human Resource Management (SHRM) offers this resource on Workplace Mindfulness.
What is the Workplace Mindfulness Summit?
We've created the Workplace Mindfulness Summit to help you discover insights and learn best practices on how to grow and expand workplace mindfulness programs. Curating the top sessions on workplace mindfulness from our in-person and online events over the last 2 years, we've assembled sessions from 11 world-class experts and case studies from 24 non-profit, government, mid-sized, & F500 organizations. You'll come away with implementation strategies & tactics that you can apply now to help boost resilience and foster mental well-being with workplace mindfulness.
This 5 day Free & Online Summit is for leaders, HR professionals, coaches, wellness professionals, and internal champions.

Learning Objectives:
• A refresher on the obligations employers have to employees when implementing terminations or layoffs, or addressing requests for leaves of absence
• A review of how COVID-19 has affected these obligations
• Strategies for addressing employees on layoff or leave whom you need back at work, or for whom you do not anticipate having sufficient work.

The business case for diversity and inclusion in a crisis
COVID-19 has changed the world. It has changed how we do business. It has changed how we operate. It has changed how we engage and interact. For how long… no one knows. It could be a few months or a year. Or it could mean a permanent new way of functioning. Uncertainty is the new normal.
But exclusion doesn’t take a break during a pandemic. In fact, there are many examples of people and organizations falling back into old patterns that are sometimes subtly, and sometimes overtly exclusionary. Now more than ever, we need to maintain our focus on diversity and inclusion to ensure people that have traditionally been marginalized are not further pushed to the edges.
CPHR New Brunswick is proud to have partner with the Canadian Centre for Diversity and Inclusion to present a free webinar called The business case for diversity and inclusion in a crisis. This webinar will outline the business case for why it is critically important for employers to maintain, and in fact expand their focus on diversity and inclusion to ensure that this new normal doesn’t exclude anyone.

Live Webinar The Mentally Healthy Workplace
DATE: | July 14th 2020 |
8:00 am to 12:00 pm |
CHAPTER: | Saint John |
LANGUAGE: | English |
What does a mentally healthy workplace look like? Imagine... Employees are engaged and passionate about their jobs, often surpassing expectations and productivity markers set by management. Management, staff and all other players motivate one another and enjoy satisfying, reciprocal professional relationships. Sick time and disability claims are at an all-time low and employee retention rates are the envy of other organizations. Morale and employee satisfaction are so exceptional that attracting qualified candidates is a breeze when vacancies come up. You develop a stellar corporate reputation and are recognized as a leader in your industry and a great place to work. Your organization absolutely thrives! Sounds good, right?
This session will equip you with the necessary tools to be proactive about workplace wellness and foster a psychologically safe work environment. Mental health issues account for about one third of all disability claims in Canadian workplaces, and 70% of the total costs. In addition to the impact of absenteeism, many organizations are experiencing diminished productivity, disengagement and other effects of “presenteeism”—employees being physically present at work but functioning below their capacity due to mental distress. Employers have a duty to make reasonable accommodations for health conditions whether physical or mental in nature but offering support and implementing accommodations can be complex when it comes to mental health concerns. Topics covered in this session will include:
- Mental health: what it is, its place in our overall health and its impact in the workplace
- Stigma, and the blatant and more subtle forms this type of discrimination can take
- Legal responsibilities and rights of the employer and employee, including the duty to inquire, duty to make reasonable accommodations
- Understanding depression and anxiety, the most common mental disorders in Canada
- Talking about mental health problems in the workplace: practical conversation tools
- Connecting employees with professional support: who, what, when and how?
- Resources, next steps and easy-to-implement strategies to be proactive (vs. reactive) and promote positive mental health at work and at home
Join Psychological Health & Safety Consultant Elizabeth Eldridge for a thought provoking morning exploring the many implications of mental health at work and its relevance to your role as a Human Resource Professional.

When life doesn't go as planned: How Larry Linton uses mindfulness to thrive after a Parkinson's diagnosis
In the midst of a global crisis, most of us no longer have to imagine what it would be like for our lives to be completely changed by unexpected bad news.
How do we cope when life throws us a curve ball? How do we move forward from it? How do we learn to thrive in our new realities?
Larry Linton, B.A., LL.B, C.S., was progressing steadily through his career as a corporate immigration lawyer when he came face-to-face with a life altering diagnosis of Parkinson’s Disease in 2012.
In this engaging and entertaining webinar, Larry will take us on his life’s journey after his diagnosis and how he reinvented himself emotionally and physically to live a life with Parkinson’s Disease that, in many respects, is more rewarding, fulfilling and meaningful after his diagnosis than before.
Dr. Geoff Soloway, MindWell Founder, will speak with Larry about:
-
How he coped during the dark days following the diagnosis
-
How he deals with the motor symptoms of Parkinson’s (exercise!)
-
How a daily mindfulness practice has helped him deal with the non-motor symptoms of the disease
By sharing his life story and the coping skills that he has developed, Larry hopes to inspire others faced with a chronic illness or life changing event to live their most authentic lives, too.

This virtual session will outline employers’ current and forthcoming legal obligations to prevent and respond to discrimination and harassment against 2SLGBTQI+ employees, including under human rights and occupational health and safety legislation, as well as best practices to help create safer and more welcoming workplaces for members of the 2SLGBTQI+ community

Violence Threat Assessment Planning and Response
This is a live virtual event using Zoom, an online meeting platform. Please check system requirements prior to registering.
After a violent incident, it is not uncommon to find that people were aware of clues that violence was being planned. This is because most violent incidents often follow an evolutionary process where signs and indicators can be seen. Yet, without a clearly defined process to gather information and assess the situation, violence prevention is extremely difficult. This webinar provides a communication and decision-making model to help businesses, schools, organizations, and communities become more effective in their management of threats. Viewers will learn strategies to help them identify, assess, and manage individuals who may be escalating towards violence.
