Join our expert panel of labour lawyers from Mathews Dinsdale and a QEII medical doctor specializing in infectious diseases on March 27, 2020.
With COVID-19 appearing prominently in news headlines these days, both federal and provincial governments are encouraging preparedness. What is an employer’s responsibility to employees in the event of wide-scale infection? What steps can an employer take in advance to ensure preparedness? While specific guidelines and responsibilities exist for those working in health care, an employer in any industry can benefit from having a workplace pandemic plan in place.
In the event COVID-19 spreads widely within Canada, employers have the same legal duties under occupational health and safety, employment standards and human rights legislation as they would with any other illness impacting employees. One of the primary considerations will be whether employees can reasonably refuse to attend work for safety reasons if and when COVID19 is present in the workplace.
This session will provide an overview of the obligations employers will have in the event there is a widespread outbreak of COVID-19 in Nova Scotia and will address the occupational health and safety; human rights; and employment related responsibilities employers should be aware of in the coming months. Importantly, this session will also feature important information on the medical aspects of COVID-19 from Dr. Brent Culligan. Dr. Culligan is a is a specialist in Internal Medicine at the QEII Health Sciences Centre.
Learning Objectives
In this session, participants will learn:
- The most up-to-date medical perspective on the origins and spread of COVID-19;
- The various ways in which employers can address the spread of COVID-19 in the workplace, including restricting the activities of its employees;
- The circumstances in which an employer may prevent an employee from reporting to work;
- Whether an employer needs to accommodate lengthy absences from the workplace;
- When an employer should permit an employee to work from home;
- The circumstances in which an employee can refuse work under the Occupational Health and Safety Act; and
- What obligations an employer will have in the event it must close its business for a period of time.
About the Panel
Tara Erskine, QC is a partner in the Halifax office of Mathews Dinsdale & Clarke LLP. Working from the Halifax office, Tara provides strategic advice to employers across Canada and works as a partner with human resource professionals and in-house counsel.
A member of the Nova Scotia Barristers’ Society, the Law Society of Ontario and the Law Society of Alberta, Tara is a Certified Professional in Human Resources (CPHR) (formerly CHRP). She has completed negotiation training at Harvard Law School and the Canadian Mediation Institute. In 2003, she spearheaded the founding of the Canadian Association of Counsel of Employers (CACE) and was its first director. Tara served as a Commissioner (Part-time) of the Canadian Human Rights Commission from 2014 to 2017.
Tara was appointed Queen’s Counsel in 2016. She has been recognized as a leader in Labour and Employment Law in Canada in Who’s Who Legal – Canada since 2017 and by Best Lawyers in Canada in the field of Labour and Employment Law.
Dr. Brent Culligan, FRCPC, is a specialist in Internal Medicine at the QEII Health Sciences Centre and is an Assistant Professor in the Department of Medicine, Dalhousie University. He received his medical degree from McMaster University and completed residencies in Family Medicine and Internal Medicine at Dalhousie University with fellowship training in Critical Care and Infectious Diseases. He has a diploma in Tropical
Medicine from the Gorgas School of Tropical Medicine in Lima, Peru.
Kyle MacIsaac is a partner in a partner of Mathews Dinsdale & Clark LLP working out of its Halifax office. Kyle advises employers in all areas of workplace law. He understands the realities of business and the issues facing employers and provides timely and practical advice and solutions to his clients. Kyle represents provincially and federally regulated employers concerning both labour and employment matters, including those concerning human rights issues, employment standards and employment contracts, wrongful dismissal, occupational health and safety, union organizing, collective agreement interpretation, grievance handling, progressive discipline and investigations into employee misconduct. Discrimination on the basis of family status is an ever-evolving concept that arises in every workplace. Many employees are dealing with child-care obligations in addition to care of parents, while employers struggle to deal with the absences and special arrangements that such accommodation can involve. The session will review the current state of the law on family status discrimination and provide a practical guide as to how employers can simultaneously meet the demands of the workplace and their legal obligation to accommodate their employees' family status.
The law on accommodation of family status is not consistent across the country, with some important differences in employer obligations depending on whether the employment is federally regulated or provincially regulated. Some provinces, such as British Columbia, have a different test for reasonable accommodation.
This session will be tailored for Nova Scotia employers, with a review of the obligations to accommodate family status and the limits of that accommodation. We will provide a road map of how to handle such requests for accommodation, including what information may be requested of employees, and what sort of “family matters” may have to be accommodated. Does it include time off to attend a child’s hockey game or just medical appointments? Does it matter if the child has special needs? What if the employee need to care for an elderly parent?
We will review decisions interpreting the Nova Scotia Human Rights Act as well as decisions from Nova Scotia labour arbitrators on this important topic.
In this session, participants will learn:
- The various ways in which the issue of discrimination of family status can arise;
- The law that applies to Nova Scotia employers with respect to family status accommodation, whether provincially or federally regulated and the legal tests and how they differ from some other provinces;
- A discussion of family status issues and benefits;
- Addressing issues of anti-nepotism policies and issues that arise when family members work together;'
- The current state of the law and recent decisions on family status discrimination;
- Proactive policies and procedures that employers can take that will assist in addressing family status issues; and
- A step by step approach that employers can take when their employees do request accommodation based on family status.

It's time to be proactive and respond with an abundance of care. Recently, Qualtrics published The Other COVID-19 Crisis: Mental Health surveying 2,000 employees and found:
- 67% of people report higher levels of stress since the outbreak of COVID-19.
- 42% report their overall mental health has declined.
The top two things respondents reported impacted their mental health decline were more anxiety (24.0%) and more stress (20.1%)
What is Workplace Mindfulness?
The modern workplace is not a physical location, it is the place, whether physical or online, that people come together to work. Mindfulness is a human ability to be present that is developed through various practices, primarily meditation.
Mindfulness is the basic human ability to be fully present, aware of where we are and what we’re doing, and not overly reactive or overwhelmed by what’s going on around us. (from Mindful.org)
Workplace mindfulness programs have proven to be cost effective measures to reduce anxiety & stress while boosting resilience and fostering mental well-being. The Center for Disease Control's Mental Health and Coping During COVID-19 page lists one of the top methods to cope with stress as meditation. The National Institute for Health offers this resource on "What the Science Says About the Effectiveness of Meditation". And the Society for Human Resource Management (SHRM) offers this resource on Workplace Mindfulness.

A 2017 study of LGBT Canadians found that 40% of respondents reported discrimination related to their sexual orientation or gender identity. Of those respondents, 40% reported experiencing discrimination in the workplace.
A 2015 study of trans people in Ontario found that 13% had been fired explicitly for being trans, 18% were turned down for a job explicitly for being trans, and 17% declined a job they had applied for and were offered due to the lack of a safe and trans-positive work environment.
This virtual session will outline employers’ current and forthcoming legal obligations to prevent and respond to discrimination and harassment against 2SLGBTQI+ employees, including under human rights and occupational health and safety legislation, as well as best practices to help create safer and more welcoming workplaces for members of the 2SLGBTQI+ community

Critical Incident Group Debriefing

Critical Incident Group Debriefing (CIGD) is a short-term group intervention process that focuses on an immediate event. CIGD is one of several methods that may be utilized to lessen the likelihood of people experiencing symptoms of trauma and stress after a critical incident. This group debriefing process provides a place for participants to talk and share experiences, and for the facilitator to teach and provide information about the impact of critical incidents.
