Tom Devine, Legal Director, Government Accountability Project and Advisory Board Member, Whistleblowing Canada. There is a global legal revolution in whistleblower rights, which have expanded from the United States as the first nation in 1978, to 62 countries after the 2020 European Union Whistleblower Directive. But are these laws written to provide genuine protection, and are they working in practice? Whistleblower laws that provide false advertising for rights can be a trap that threatens freedom of speech by identifying dissenters and then rubber-stamping whatever retaliation is sought. The Government Accountability Project and the International Bar Association has just -completed a study assessing global whistleblower laws for their legitimacy – comparing the rights on paper to global best practices, and their rights in reality based on track records. Canada finished tied for last, with Lebanon. GAP legal director Tom Devine will explain and unravel the "fraud" of Canada’s whistleblower law, and outline the steps necessary for it to provide genuine protection. Tom has worked at GAP since 1979. Since that time, Tom has formally or informally assisted over 7,000 whistleblowers in defending themselves against retaliation and in making real differences on behalf of the public.He has not lost a case since 2006, and has prevailed in advocacy at numerous U.S. courts of appeals as well as the Supreme Court. Tom has been a leader in the campaigns to pass or defend 34 national or international whistleblower laws, including nearly all in the U.S. federally enacted over the last two decades.
