Kelly Vanbuskirk Kelly obtained his Law Degree from the University of New Brunswick in 1992, and completed a Master of Laws in 2003. In 2013 he completed the Employment Law Mediator Program from Cornell University, and is currently conducting research into the motivation of employees to pursue legal resources against employers. Kelly has worked with Lawson & Creamer since 1996, and became a Partner in 2000. He was an Instructor of Law for 7 years at the University of New Brunswick, and has been an Instructor with the Law Society of New Brunswick for the past 17 years. He is an appointed arbitrator under the Occupational Health & Safety Act, and mediator appointed by the New Brunswick Human Rights Commission. He is also a member of the Cornell University Panel of Neutrals. Kelly has written a number of publications for The Solicitor’s Journal, Workplace Today magazine, the Canadian Bar Review, Insight Information Co., the Human Resources Association of New Brunswick, and the Canadian Bar Association to name a few. Kelly is also an active volunteer in the community and some of his current positions include Director of the Saint John Regional Hospital Foundation, a minor hockey coach and President of Hockey NB Elite Draw Zone Area South. | ||

This session will focus on why employers, unions and employees need to rethink their approaches to grievances and complaints made under collective agreements, the Human Rights Act, and the Occupational Health & Safety Act. Employer considerations regarding procedural approaches to grievances and complaints will also be discussed. A number of recent cases of interest in the unionized environment will be highlighted to provide insight into what employees are really seeking in the context of grievances and complaints and how to achieve the most efficient and effective outcomes. | ||
