The presentation will feature a review of recent legal cases in the areas of labour and employment law from courts and tribunals, including decisions which are likely to be of interest to HR professionals. We will also address the recent legislative amendments to the Employment Standards Act with respect to leaves for the purpose of dealing with domestic violence which came into force as of September 1, 2018. As well, amendments to the NB Occupational Health and Safety Act will impose new obligations on employers in New Brunswick regarding harassment and violence in the workplace. The changes come into force on April 1, 2019 and require employers who do not have a written harassment policy to implement one, with some specific features and training requirements as well as the involvement of the joint occupational health and safety committee (JOHSC). It will also mean that employers who have a harassment policy in place will need to review it to ensure it complies with the Regulation in terms of content, training and frequency of reviews. Finally, all employers will be required to conduct an assessment of the risk of violence in the workplace. Where a risk is present, there is a requirement to implement a policy. The session will give HR professionals the information they need to ensure that their workplace complies with the new Regulation. |
