We are currently witnessing the increase of awareness about transgender issues in what Time Magazine (June 2014) has dubbed the "next civil rights frontier." In 2016, the Trudeau administration has introduced Bill C-16 to provide transgender people with full rights and protections in the Canadian Charter of Rights. As the political, social, and legal landscape improves, more transgender people feel comfortable to share their innermost truth regarding their gender identity within the workplace. Are you ready to support the transitioning employee as well as their co-workers and clients with this change?
Transition planning entails a systems approach to identifying and discussing a complex set of interrelated factors that require sequenced coordination to allow an employee, their co-workers, and possible clients to smoothly and to confidently transition their gender on the job. Through the use of transition guidelines you can work with the transgender employee to consider how to best engage co-workers and possible clients.
For many, transgender issues in the workplace are new territory. Concepts of gender identity may feel overwhelming. The presenters bring an open and friendly approach to provide a session that aims to be highly interactive and engaging. In particular, through evocative icebreakers we begin by situating attendees within their own experiences of gender identity to demystify, clarify, and reduce the trepidation and hesitation typically associated with this topic. The presentation is highly interactive, thought provoking and guaranteed to generate good, deep, discussion about how Change is, and should be, implemented in an organization. It is also, unavoidably – fun.
What must we do to bring about a Change initiative as smoothly as possible? Communicate! Communicate! Communicate! How much, and for how long do we do this? Until we get sick and tired of the sound of our own voice – then we take a deep breath and a drink of water and we start all over again. Communication isn’t something that stops and starts; it’s a constant activity before, during and after any Change initiative.
This isn’t exactly news. We sort of get this. I can ask any audience in the world to tell me the ‘secret’ to good Change and they repeat back “Communicate, Communicate and Communicate some more!” as if it’s been forcefully injected into their cerebellum. The problem arises when the questioning becomes a bit more detailed, “What exactly should we communicate?”
The response to that question is usually either a blank stare or the reasonable recitation of the reporter’s standby; Who, What, Where, When, How and Why. Not a bad start. If we’re writing a news article, then these are good solid questions. The Change Management problem requires all of those, and a few others besides. It’s not that the reporter’s questions are a poor tool; it’s just that they don’t address the peculiar psychology of the Change challenge.
When faced with Change – here are the questions that demand answers:
- WHY? – Why is this particular Change necessary now?
- WIIFM? (What’s in it for me) – If we don’t address this? They’ll listen to nothing else.
- MONDAY? – What exactly will we be doing differently tomorrow?
- WON’T? – What won’t Change?
- MIGHT? – What might go wrong, and what are our plans to mitigate that?
- WILL? – What will be difficult and what will we do to make that easier?
- SIGNPOSTS? – How will we know we’re making progress?

The presentation will feature a review of recent legal cases in the areas of labour and employment law from courts and tribunals, including decisions which are likely to be of interest to HR professionals. We will also address the recent legislative amendments to the Employment Standards Act with respect to leaves for the purpose of dealing with domestic violence which came into force as of September 1, 2018. As well, amendments to the NB Occupational Health and Safety Act will impose new obligations on employers in New Brunswick regarding harassment and violence in the workplace. The changes come into force on April 1, 2019 and require employers who do not have a written harassment policy to implement one, with some specific features and training requirements as well as the involvement of the joint occupational health and safety committee (JOHSC). It will also mean that employers who have a harassment policy in place will need to review it to ensure it complies with the Regulation in terms of content, training and frequency of reviews. Finally, all employers will be required to conduct an assessment of the risk of violence in the workplace. Where a risk is present, there is a requirement to implement a policy. The session will give HR professionals the information they need to ensure that their workplace complies with the new Regulation.
