Karl Jessop, CRIA, is a partner with the law firm Cain Lamarre Casgrain Wells. His practice focuses primarily on labour relations, work accidents and health and safety. Mr. Jessop also acts as counsel in labour relations cases. He is frequently called on to negotiate collective agreements in the manufacturing, municipal, transport and retail fields. Today’s employers must face new challenges, especially when it comes to regulating workplace technologies and monitoring employees. Not to mention that the fact that this subject raises many questions regarding employees’ fundamental rights adds an additional challenge. It is therefore quite reasonable for employers to question themselves on the scope and on the limits of the law in this matter. Learning objectives At the end of the course, the participant will be able to: • Understand the principles behind employee monitoring and regulating the use of technologies. • Identify the scope and also the limits of employer rights regarding employee monitoring and regulating the use of technologies. • Identify the cases where disciplinary action is warranted. • Apply legal principles to concrete examples taken from case law.
