Agenda • Outlining the Facts of the Dependent Contractor Issue • Outlining the risks of having your contractors reclassified as Dependent • Outlining Common Misconceptions • Explaining how the PCSI model mitigates the risks for both Employers and the contractors with whom they engage • Outlining the benefits of the CRA Compliant Solution for both contractors and the Employers with whom they engage Background Canadian companies are responding to the shift in the economy by increasing their contingent workforce. Currently, there are nearly 3 million self-employed Canadians, with the vast majority being independent contractors. For companies, contractors are the cornerstone of a flexible staffing model that aligns well with the cyclical and seasonal nature of many industries. However, over the past few years there have been significant changes made to the business criteria and classifications that directly impact independent contractors, exposing these contractors to financial risk. The Federal Trudeau Government has increased its resources at CRA to pursue Independent Contractors for tax avoidance. At the same time, Canadian courts have begun to create the potential for severance liability for the companies that utilize these contractors by deeming many of these resources to be “dependent contractors”. This potentially entitles them to the same benefits owed to full-time employees. With the risk factors increasing exponentially for both contractors and the companies that wish to engage them, the future of the independent contractor model would appear to be in jeopardy.
