Absence can be a significant cost to an employer both as direct benefit costs and losses of productivity. In addition the indirect costs associated with absence that can effect engagement, presenteeism and burn out of other employees. Don’t isolate those working in isolation
Companies of all shapes and sizes can have employees who feel isolated, needing more support from employers.
Workplaces, no matter the size or industry, have a key role to play in promoting and supporting the well-being of its employees. But what happens when the workplace is not clearly defined within four office walls or filled with a team? What happens when employees are working on their own in isolation?
The trucking industry, where the boundaries of a typical workplace don’t apply, is one of many sectors that faces such challenges. Typical conditions for transport drivers put them at greater risk of and increased exposure to psychological harm without the proper supports to prevent or address it.
An employee doesn’t have to be trekking across the continent alone to feel isolated. From employees working at home to those stationed in satellite offices, they might need extra support from employers who can mitigate the risks of working in isolation.

Workplace Bullying
Program Summary:
A canary in a coal mine is an advanced warning of danger - so is a workplace bully. Research shows that more than 70% of North American workers have been impacted by bullying. While employers slowly become more informed of the impacts associated with bullying, HR personnel encounter many challenges when attempting to prevent and respond to it. HR often feels "caught in the middle" - they see the problem and what it's costing (sick leave, stress leave, loss of talent, conflicts, team demotivation, reputation loss) but they don't know how to deal with it.

Join us for our annual legal update with Lucie LaBoissonnière and Dominique Fontaine from McInnes Cooper. By popular demand based on membership feedback, Lucie and Dominique will begin the half-day session by giving tips and advice on managing medical absences. The second half of the session will be dedicated to a discussion on recent cases of interest and trending topics.
While every employer has to manage medical absences, this task is never easy. The rights and obligations of employers and employees must be balanced: employers have a right to require regular attendance and punctuality, while employees benefit from a wide range of rights under human rights legislation, employment standards legislation and the common law. When does innocent absenteeism lead to a frustration of the employment contract? When can an employer ask for medical justification for an employee’s absences? Does the employer have a responsibility to continue to pay and provide benefits when an employee is on medical leave of absence? The first half of the session will focus on managing medical absences.
The second half of the session will be an overview of recent cases of interest and trending topics.
A recent New Brunswick case suggests that many employers are not properly training and re-training their employees on workplace policies. A simple employee sign-off on a policy may be insufficient to convince a court or an arbitrator that the employee understood a policy and the consequences of its breach. This session will offer several tips on how to ensure your employees are aware of the workplace policies – and how to prove it.
On July 14, 2016, the Supreme Court of Canada decided that the “Unjust Dismissal” sections of the Canada Labour Code protects non-unionized federal employees from termination of their employment without cause. Non-unionized employees working in federally-regulated businesses now enjoy the same “just cause” protection that most unionized employees have in their collective agreements. The decision means that, federally-regulated employers must meet the higher bar of just cause for dismissal before they can terminate an employee’s employment. The impact of this decision will be discussed at the session.
Finally, in the last year, there has been many discussions on the rights of transgender employees. These employees face many challenges in the workplace, not the least of which are vulnerability to and fear of discrimination. The session will discuss several ways in which an employer can support these employees.

Many people who live with chronic pain report that they also suffer from low mood, irritability, and withdrawal from activities and relationships. Although traditionally this was conceptualised as 'depression', new evidence suggest that it is qualitatively different from clinical depression, and not surprisingly, the interventions that have been developed for groups with clinical depression don't seem to be of much help in the context of chronic pain. I will describe this evidence and suggest ways in which clinicians can distinguish between depression and pain-related distress. I will also describe current intervention and propose ways of improving clinical and self-management for people with chronic pain.

Fear-Avoidance Beliefs and Chronic Pain

It has been well-established that patients with chronic pain will often avoid activities that may exacerbate their pain. In the basic fear-avoidance model, if individuals are especially sensitive to the negative experience of pain, this will result in pain-related fear of movement, avoidance of daily activities that may result in pain, as well as hypervigilance or overmonitoring of bodily sensations of potential increase in pain. This fear-avoidance can, in turn, result in physical de-conditioning, depression, as well as disability/avoidance of work, recreation, and/or family activities.
Clinical research has clearly revealed that this construct of fear-avoidance is closely associated with increased pain, physical disability, and long-term sick leave in chronic pain patients. Because it is so prevalent in chronic pain patients, psychometrically-sound instruments have been developed to measure fear-avoidance, such as the Fear of Daily Activities Questionnaire (FDAQ), the Tampa Scale of Kinesiophobia (TSK), and the more recent Fear-Avoidance Components Scale (FACS). Fortunately, there are now treatment techniques that can successfully reduce fear-avoidance beliefs and behaviors in patients with pain.
